General Liability Program Operating Memorandum #06-02 Effective June 1, 2006

Issued pursuant to the Memorandum Stating the Terms and Conditions of the General Liability Risk Sharing Program Administered by the California Fair Services Authority," adopted effective January 1, 2004 (hereinafter "MOC")

Section 1. Minimum Liability Limits for Specified Fair Contractors and Facility Users

All fairs participating in the CFSA general liability program described by the MOC must insure that fair contractors and other users of fair facilities maintain the following minimum per occurrence limits of commercial general liability coverage for the following activities:

  • Fairtime Carnival Rides

$3,000,000

  • Motorized Events: Automobile, or motorcycle races, truck rodeos, tractor/truck pulls, destruction derbies, mud bogs, mud racing, go cart racing, car crunches, and motorized thrill shows.
  • Rodeo Events: All Types with a paid gate and any Rough Stock Events, such as Bull Riding, Bareback or Saddle Bronc.

$2,000,000

  • Interim Carnival Rides
  • Concerts: Over 5,000 Attendees
  • Rave Type Events: Any dance or concert which extends beyond midnight.
  • Mechanical Bulls
  • Extreme Attractions: All types, including but not limited to: bungee attractions, ejection seats, sky scrapers, free fall attractions, or similar attractions.
  • Orbitrons
  • Rodeo Events: All types without a paid gate and with any Rough Stock Events, such as Bull Riding, Bareback or Saddle Bronc.
  • Simulators
  • Motorized Events: Any arena or track motorcycle racing, including arena-style motocross, and go-cart racing.
  • Fairtime Kiddie Carnival Rides: Up to 6 kiddie rides.

$1,000,000

  • Animals:  All types of events, including by not limited to circuses, pony and other animal rides, petting zoos, pig races, dog training classes, horse drawn refuse collection, and horse-pulled hay rides.
  • Athletic Events, Competitions: All Types
  • Buildings: Major repair, major alterations, new constructions of buildings, excavation, drilling and demolition
  • Concerts (Non-Rave Events): Under 5,000 Attendees
  • Elevator Maintenance
  • Entertainment: Trapeze, spin wheel or acrobatic acts, tight rope, boxing matches, and wrestling
  • Equestrian Events:  All types of events, including but not limited to horse shows, jousting, cutting and reining horses (training and lessons), gymkhana, team penning, team roping, barrel racing, dressage, and show jumping.
  • Equipment (High Rise):  Sound/Lights, tents, bleachers, portable stages, and scaffolding
  • Firework Exhibitions
  • Food Concessionaires
  • Hazardous Substances:  Treatment, removal, storage or any other handling of any hazardous substances, including but not limited to toxic and petroleum waste and asbestos
  • Medical Services:  EMT, first aid services, and ambulance services
  • Miscellaneous:  Dunk tanks, tattooing, parachuting, bouncy balloons, trampoline use
  • Parades
  • Receptions, Social Gatherings:  All types where food or liquor is served or where over 100 attendees
  • Rodeo Events:  All types of events without any Rough Stock Events, such as Bull Riding, Bareback or Saddle Bronc
  • RV Rallies
  • Security:  Public and private
  • Sewer Lines, Maintenance and/or installation
  • Shows, Flea Markets:  All types, including but not limited to boat shows, car shows, coin shows, craft shows, flea markets, flower shows, gun shows, home and garden shows and trade shows
  • Sport Activities:  Rifle or gun club activities, archery practice, skeet range, golf driving ranges, laser tag and paint ball
  • Spraying:  Pest control, fumigation, crop or agricultural spraying and application
  • Transporting:  All types, including, but not limited to helicopter, stage coach, horse-pulled hay rides, trackless trains, hot air balloons, any aircraft (fixed wing or rotor), watercraft, and armored car services
  • Wheeled Events:  All types, including but not limited to roller derbies, roller skating, in-line skating, hockey, scooters, skateboards, bicycles, and BMX events

Section 2. - Insurance Certificate/Additional Insured Requirements

All fairs participating in the CFSA general liability program described by the MOC must obtain a certificate of insurance for each of the activities listed in Section 1. above and such certificate of insurance must include the following additional insured language: "That the State of California, the District Agricultural Association, County Fair, the County in which the County Fair is located, Lessor/Sublessor if fair site is leased/subleased, Citrus Fair, or California Exposition and State Fair, their agents, directors, officers, servants, and employees are made additional insured, but only insofar as the operations under this contract are concerned."

Section 3.  - Effective Date

This Operating Memorandum shall become effective June 1, 2006 at 12:01 am Pacific Standard Time and shall apply to all contracts and rental agreements, and extensions of any contracts or rental agreements, entered into by a participating fair on or after such effective date. General Liability Program Operating Memorandum #02-01 shall remain in effect only until this Operating memorandum #06-02 becomes effective.

Section 1. Fair Promoted Motorized Events

 

  1. All fairs participating in the CFSA general liability program ("participating fair(s)") that self-promote any motorized event must maintain separate commercial general liability insurance coverage for the motorized event. This coverage must meet the current Insurance Requirements (minimum liability limits set for specific fair contractors) issued by CFSA. The participating fair must maintain this coverage any time a motorized event occurs at the participating fair's grounds and there is no promoter, contractor, or sponsor providing commercial liability coverage including, but not limited to, co-promoting arrangements "motorized events" include but are not limited to, automobile or motorcycle races, truck rodeos, tractor or truck pulls, destruction derbies, mud bogs, mud racing, go cart racing, car crunches, and motorized thrill show.
  2. Participating fairs must provide CFSA with a signed original insurance certificate (ACORD for is acceptable) evidencing the required commercial general liability coverage at least (7) days in advance of any motorized event covered by Section 1.A above. This coverage must meet the then current Insurance Requirements issued by CFSA.

Section 2. Fair Promoted Rodeo Events

  1. All fairs participating in the CFSA general liability program ("participating fairs(s)") that self-promote any rodeo events must maintain separate commercial general liability insurance coverage for the rodeo event. This coverage must meet the then current Insurance Requirements (minimum liability limits set for specified fair contractors) issued by CFSA. The participating fair must maintain this coverage any time a rodeo event occurs at the participating fair's grounds and there is no promoter, contractor or sponsor providing commercial liability coverage, including, but not limited to, co-promotion arrangements.
  2. Participating fairs must provide CFSA with a signed original insurance certificate (ACORD form is acceptable) evidencing the required commercial general liability coverage at least seven (7) days in advance of any rodeo event covered by Section 2.A. above. This coverage must meet the then current Insurance Requirements issued by CFSA.

Section 3. Non-Compliance

The policy for Non-Compliance with CFSA Operating Memoranda set forth in CFSA Operating Memorandum #03-01, Section 2, is applicable when a participating fair fails to comply with the requirements of this, or any other, CFSA General Liability Operating Memoranda. In the event of a loss, and depending upon the particular circumstances and number of prior offenses, the application of the Policy for Non-Compliance could result in the imposition on the participating fair of the loss participation percentage (fair pays percentage of all sums paid by CFSA on the claim), the imposition of other financial penalties and/or termination of the participating fair from the CFSA General Liability Program or from CFSA.

Section 4. Effective Date

This Operating Memorandum shall become effective June 1, 2006, at 12:01 am Pacific Standard Time and Shall apply to all motorized events and all rodeo events occurring on or after such effective date. General Liability Program Operating Memorandum #05-01 shall remain in effect only until this Operating Memorandum #06-03 becomes effective.
